Welcome to the Full View^® service, a personal information management service (the "Service") made available to you by Fidelity Brokerage Services LLC, Fidelity Investments Institutional Operations Company, Inc., and/or their affiliates ("Fidelity"). These Terms of Use ("Terms") govern your use of the service.

Terms of Use

The Service
1. Description of the Service. The Service is an information management service that allows users to consolidate and manage their information on the Fidelity web sites and through a variety of web-based planning tools that Fidelity may make available on its web sites. With the Service, users may view and maintain information stored at various web sites. The information includes your Fidelity account information stored on Fidelity's web sites ("Fidelity Account Information") and your information stored on other web sites ("Account Information from Third Party Sites"). Yodlee Inc. ("Yodlee") provides Fidelity services to access third party sites. Yodlee an independent business and is not affiliated with Fidelity. With the Service, upon your request, Fidelity obtains your Account Information from Third Party Sites and your Fidelity Account Information.
2. Third Party Information, Content, Products and Services. Other than the Fidelity Account Information, all other information available through the Service is provided by third parties. Fidelity makes no effort to review the content of any third party sites, including, but not limited to, the validity, legality, copyright compliance, or decency of the content contained in these sites. You acknowledge that Fidelity does not pre-screen content, but that Fidelity and our designees will have the right (but not the obligation) in our or their sole discretion to refuse, edit, move or remove any content that is available via the Service. Fidelity is not responsible for the products and services at third party sites.
  
  Any third party information about securities and other investments available through the Service reflect independent opinions and are not recommendations by Fidelity. Fidelity does not evaluate or guarantee the suitability or potential value of any particular investment or information source. The information and content provided via the Service is for information purposes only and should not be construed as an offer to sell, a solicitation to buy or a recommendation of any security or other investment by Fidelity. You acknowledge that you must perform your own evaluation of any investment based on your investment objectives, financial resources and risk tolerance. Fidelity will not utilize third party information provided through Full View for the purpose of determining the suitability of any securities transactions between you and Fidelity. In addition, this information will not be used to update any suitability information that Fidelity may have on file for you.
3. Service Limitations. Fidelity will try to make your experience a productive one. However, Fidelity cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data, personalization settings or other service interruptions. Fidelity cannot assume responsibility for the timeliness, accuracy, deletion, mis-delivery or failure to store any user data, communications or personalization settings. For example, when displayed through the Service, Fidelity Account Information and Account Information from Third Party Sites are only as fresh as the time shown, which reflects when the information is obtained from such sites. Such information may be more up-to-date when obtained directly from the relevant sites. You can refresh your account information on the Service any time you are logged in by selecting "refresh".
4. Right to Change. Fidelity reserves the right to modify, change or cease providing access to the Service or any of the content or third party sites available through the Service at any time and without prior notice.
5. Privacy. Fidelity is committed to maintaining the privacy and security of its customers' personal information. Fidelity's commitment to privacy is reflected in our privacy policy. For more information, please read Fidelity's full privacy policy on Fidelity.com or NetBenefitsSM. In addition, Fidelity makes the following commitments for your use of the Full View service:
6. Cancellation. You may cancel your enrollment in this Service at any time by contacting Fidelity through the Full View Account Maintenance Page accessible from the Customize Full View link on the Full View service.
  
  Fidelity may cancel your enrollment in the Service at anytime without prior notice, for any reason, including, for those accessing the Service through NetBenefits, at the direction of your employer or plan sponsor.
Your Use of the Service
1. Provide Accurate Information. Accurate records enable Fidelity to provide the Service to you. You must provide true, accurate, current and complete information about yourself and your accounts maintained at other web sites, as requested in our registration form and account setup forms, and you may not misrepresent your identity or your account information. In order for the Service to function effectively, you must also keep your registration and account information up to date and accurate.
2. Guard Your Fidelity PIN and other Log-in Information. You are responsible for maintaining the confidentiality of your personal identification number ("PIN") and other log-in information. You are fully responsible for all activities that occur using your PIN and other log-in information, including, but not limited to, trades submitted for execution and funds transfers through the Fidelity site or any third party site. You may not use anyone else's PIN or other log-in information at any time.
3. Obey the Law. You may not use the Service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous (untrue and damaging to others), invasive of another's privacy, abusive, threatening, or obscene, or that infringes the rights of others.
4. Restrictions on Commercial Use or Resale. Your right to use the Service is personal to you; therefore, you may not resell or make any commercial use of the Service.
5. Proprietary Rights. You acknowledge and agree that Fidelity owns all rights to this web site. You are only permitted to use the content as displayed on this site as expressly authorized by the Service. You may not copy, reproduce, distribute, or create derivative works from this content. Further, you may not reverse engineer or reverse compile any of Fidelity's technology, including but not limited to, any Java applets associated with the Service.
Rights You Grant to Us
1. Content You Provide. Subject to the Full View Privacy Policy (see Section 2E above), you are licensing to Fidelity any information, data, passwords, usernames, PINS, other log-in information, materials or other content (collectively, "Content") you provide through the Service. Fidelity may use, modify, display, distribute and create new material using such Content but only to provide the Service to you, or to facilitate your use of Fidelity financial planning tools and calculators, at your option. By submitting Content, you represent that you are entitled to submit it to Fidelity, and that Fidelity may use it for the purposes set forth above without the payment of any fees and without any time limitation.
2. Account Information From Third Party Sites. By using the Service, you expressly authorize Fidelity to access Third Party Sites, on your behalf as your agent, to retrieve account information requested by you. When you use the "Auto-Login" feature of the Service, a new browser window will open and directly connect you to your third party account Web site. Fidelity will submit information including usernames and passwords that you provide to log you into the site. Any transactions or other activities at such sites are not made through the Service and Fidelity assumes no responsibility for such activities. You hereby authorize and permit Fidelity to use information submitted by you to the Service (such as account passwords and users names) to accomplish the foregoing and to configure the Service so that it is compatible with the third party sites for which you submit your information. For all purposes hereof, you hereby grant Fidelity a limited power of attorney, and you hereby appoint Fidelity as your true and lawful attorney-in-fact and agent with full power of substitution and resubstitution, for you and in your name, place and stead, in any and all capacities, to access third party sites, retrieve information, and use your information, all as described above, with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with such activities, as fully to all intents and purposes as you might or could do in person. YOU ACKNOWLEDGE AND AGREE THAT WHEN FIDELITY IS ACCESSING AND RETRIEVING INFORMATION FROM THIRD PARTY SITES, FIDELITY IS ACTING AS YOUR AGENT, AND NOT AS THE AGENT OF OR ON BEHALF OF THE THIRD PARTY. You understand and agree that the Service is not sponsored or endorsed by any third party account providers accessible through the Service.
Other Important Legal Matters
1. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF THE SERVICE AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE FROM THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FIDELITY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
  
  FIDELITY MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY THIRD PARTY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE TECHNOLOGY WILL BE CORRECTED.
  
  ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. NO INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH OR FROM THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
  
  Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above limitations may not apply to you.
  
  TO THE EXTENT THAT ANY PART OF THIS SECTION IS NOT CONSISTENT WITH ANY OTHER PART OF THESE TERMS, THEN THIS SECTION WILL CONTROL.
2. LIMITATION OF LIABILITY. YOU AGREE THAT NEITHER FIDELITY NOR ANY OF ITS AFFILIATES, ACCOUNT PROVIDERS OR ANY OF THEIR AFFILIATES, WILL BE LIABLE FOR ANY HARMS, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR TRADING LOSSES, LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF FIDELITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF GETTING SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO, THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANYONE ON THE SERVICE; (v) THE USE, INABILITY TO USE, UNAUTHORIZED USE, PERFORMANCE OR NON-PERFORMANCE OF ANY THIRD PARTY ACCOUNT PROVIDER SITE, EVEN IF THE PROVIDER HAS BEEN ADVISED PREVIOUSLY OF THE POSSIBILITY OF SUCH DAMAGES; OR (vi) ANY OTHER MATTER RELATING TO THE SERVICE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. For NetBenefits users, this limitation of liability does not relate to non-Full View services that Fidelity provides to you under the terms of any contract Fidelity may have with your employer or plan sponsor.
3. Indemnification. You agree to protect and fully compensate Fidelity and its respective affiliates and service providers from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, reasonable attorney fees) caused by or arising from your use of the Service, your violation of the Terms or your infringement, or infringement by any other user of your account, of any intellectual property or other rights of anyone. For users who access the Service solely through NetBenefits, the terms of this section apply only to participants with Fidelity Investments Section 403(b)(7) Individual Custodial Accounts.
4. Other. If any provision of these Terms is held to be unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. The laws of the Commonwealth of Massachusetts govern the interpretation and performance of this agreement, except with respect to conflicts of laws or as otherwise required by applicable law.
